Two of the people accused of acting as front men for Juan Antonio Roca, the ex Municipal Real Estate Assessor in Marbella Town Hall, have called on the court hearing the Malaya corruption case in Marbella to be released without charge.
They consider that they cannot face charges of money laundering as the case is now out of date under Spanish law. Lawyer, Victor Moreno, who is defending Jesús Bravo Méndez and Osvaldo Godfrid Grinberg, said on Monday that the purchase of the Finca La Concepción, in which his clients took part happened in January 2003, but their statements were not taken as accused until July 2007, and hence the case had expired under law.
The two men are accused of laundering the money obtained in the sale of the 800,000 square metre plot in Marbella where more than 1,600 homes and a golf course were built against the PGOU urban plan passed for the town in 1986. The prosecutor is asking for two year prison sentences and a 1.6 million € fine for the two.
Another line of defence has been tried by Juan García Alarcón, lawyer for the Countess Sandra Von Bismark, sister in law of Gunilla Von Bismark. He claimed that the Junta de Andalucía and Marbella Town Hall ‘cannot consider themselves to be prejudiced’ by the continued money laundering charge which his client is accused.
‘What business (has my client) done against public funds, or the interests of the Town Hall’, he asked. His argument is that it is Hacienda and Social Security who have been affected by the money laundered, and not the Town Hall.
